Car accidents:  If you have been involved in a car accident you are entitled to compensation for your injuries.  If you were the driver and the owner of the car and the other driver caused the accident you are entitled to recover from the other driver’s insurance company.  You are entitled to money to fix or replace your automobile and you are entitled to money for your injuries.  You are also entitled to a rental car while your car is being evaluated by the other driver’s insurance company.  If you were a passenger in an automobile you are entitled to recover either against the driver of the car that you occupied or the driver of the other vehicle, or both, depending on who was more at fault for the accident.  If you were a pedestrian and you were struck by an automobile you are entitled to recover from the driver’s insurance company.   In any event, if the at-fault driver did not maintain insurance you are still entitled to recover from your own insurance company under your uninsured / underinsured motorist policy.  The first thing you should do if you were involved in an accident is check yourself into the emergency room of your local hospital.  You should also take pictures of your motor vehicle and pictures of the scene of the accident.  In many cases the insurance company will not offer a lot of money to settle your claim.  This means that the insurance company will not pay nearly enough money in compensation for your car or for your injuries.  There are many insurance companies who are currently getting sued for bad faith claims practices and unfair trade practices.  It is always important to have an attorney to file a lawsuit against the insurance company.

Slip & Fall:  If you have suffered an injury due to a fall down you may be entitled to recovery from the property owner’s insurance company.  Many such fall downs occur on ice.  Some fall downs occur in supermarkets on fruit or liquid substances left on the floor.  Some fall downs occur on cracks in the sidewalk, or on stairs in apartment buildings, or on defective porches.  In the case of any fall down you need to prove that the property owner had notice of the defective condition of the property and that he failed to take remedial measures to correct the defect within a reasonable period of time.  The first thing to do in the case of a fall down is to report the incident to the owner or manager of the property where you fell.  It is also important to take pictures of the area where you fell, and to take down the names and phone numbers of any witnesses who were present at the scene of your accident.  It is also important to check yourself into the emergency room of your local hospital.  These cases can be difficult to prove which is why it is important to have an attorney handle your case.

Workers' Compensation:    If you were injured during the course of your employment you are entitled to collect money for your injuries.  If you missed work because of your injuries you are entitled to collect money.  If you suffer a permanent injury and have a permanent partial disability impairment rating from your doctor you are entitled to additional monies.  You may be entitled to collect monies from a third party in additional to workers' compensation if someone else was liable for your injuries.  You have the absolute right to see your own doctor.  The insurance company cannot force you to see doctors whom they recommend.  For example, many insurance companies use Concentra or some other medical providers that have been known to force injured workers to go back to work while they are still injured.  In many cases the insurance company will not tell you that you are entitled to collect additional monies for your injuries.  In many cases the insurance company will not pay nearly enough money for your injuries or they will refuse to pay your doctor for your medical treatment. There are many insurance companies who are currently getting sued for bad faith claims practices and unfair trade practices.  It is always important to have an attorney to file a lawsuit against the insurance company.

Medical Malpractice:  If you have been injured due to the negligence of a doctor, hospital, nurse, visiting nurse or dentist, you have the right to recover monetary damages.  In any such case, you must prove that the medical provider breached the standard of care.  A poor outcome does not necessarily mean that the medical provider breached the standard of care.  In order to bring such a claim you need to have all of your medical records reviewed by another doctor.  Such cases can take a number of years to resolve as doctors and hospitals vigorously defend such lawsuits.
